Patent Litigation Against Automakers Gives Standing to Non-Party Supplier, Judge Says |

A federal judge in Virginia held that a non-party supplier of fuel injection valves to some of the world’s leading automotive manufacturers being sued in an underlying patent infringement case have standing to seek a declaratory judgment that it has not infringed on a patent owner’s rights.

Robert Bosch LLC sought declaratory judgment that it had not infringed two patents owned by Westport Fuel Systems Canada Inc., which cover “high pressure fuel injection valves” that are used in internal combustion engines, most commonly in automobiles, according to the order filed Jan. 31 in the Eastern District of Virginia.
