A divided Virginia Supreme Court reversed a $1 million jury award against a detective who fatally shot a man in 2019, finding the officer’s motion to strike should have been granted because there was uncontradicted evidence that established the shooting was justified.

In 2019, a family member called Virginia Beach Police when Jeffrey Tyree was exhibiting signs that he was having a mental health crisis and approximately 10 to 15 officers arrived on scene. Tyree held a six-inch “military-style knife,” and officers attempted to deescalate the situation for more than two hours.
