Court Overturns Drug Convictions, Finding ‘Flagrant’ Police Misconduct During Warrantless Search |

The Virginia Court of Appeals has vacated a defendant’s drug convictions, unraveling a trial judge’s sentence of 40 years with 33.5 years suspended.

In a Feb. 21 opinion, the appeals court found police officers’ warrantless entry and subsequent arrest of plaintiff to be inapplicable to the factors the district court cited to justify the officers’ actions and convict the plaintiff on criminal charges.
